Terms of Service

These Terms of Service ("Terms") govern your use of creightoncommunityfoundation.org and related services operated by Creighton Community Foundation, Inc. ("CCF", "we", "our"). By using the site, donating, registering for a volunteer event, or subscribing to our newsletter, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You may use the site freely as a visitor. To donate, register for an event, or subscribe to communications, you must be at least 18 years old, or a parent or legal guardian acting on behalf of a minor.

2. Permitted use

You may use the site to learn about CCF's programs, make donations, register for volunteer events, subscribe to our newsletter, and contact us. You agree not to:

• access the site or its APIs through automated means without our express written permission;
• attempt to interfere with site availability or with other users' use;
• attempt to gain unauthorized access to staff-only systems, databases, or accounts;
• impersonate any person or misrepresent your affiliation with any person or entity;
• use the site to publish, transmit, or facilitate anything unlawful, harmful, or infringing.

3. Donations

Donations to CCF are tax-deductible to the extent permitted by U.S. federal law. A receipt suitable for IRS substantiation will be sent to the email address on the donation. Donations are processed by Stripe and are non-refundable except in cases of documented processing error (such as a duplicate charge), which we will resolve in good faith within 30 days of your request. If you set up a recurring donation, you may cancel it at any time by contacting [email protected] or by following the cancellation instructions in your receipt.

4. Volunteer participation

Volunteer events may require you to accept event-specific terms, including waivers of liability, photo releases, medical-information forms, or guardian consent. These are presented during the registration process; your acceptance is recorded with timestamp and method. Your participation in any event is at your own risk. CCF cannot guarantee event conditions, weather, partner organization conduct, or third-party transportation, and is not liable for ordinary risks associated with the activity.

If you are under 18, a parent or legal guardian must accept these terms on your behalf.

5. Intellectual property

The contents of the site — including text, logos, photographs, design, and the name "Creighton Community Foundation" — are the property of CCF or its licensors and are protected by U.S. copyright, trademark, and other intellectual property laws. You may quote brief excerpts for journalistic, educational, or commentary purposes consistent with U.S. fair use. You may not reproduce, redistribute, or create derivative works of substantial portions of the site without our written permission. CCF logos and marks may not be used to imply endorsement or affiliation without express permission.

6. Third-party links and services

The site links to and integrates with third-party services, including donor-advised-fund tools, payment processors, and partner organizations. CCF does not control those services, does not endorse their content unless explicitly stated, and is not responsible for their privacy practices or terms of service.

7. No warranty

The site is provided on an "as is" and "as available" basis. To the maximum extent permitted by Arizona law, CCF disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of information. We do not warrant that the site will be uninterrupted, secure, or free of errors.

8. Limitation of liability

To the maximum extent permitted by Arizona law, CCF, its directors, officers, employees, volunteers, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the site or participation in CCF activities, even if advised of the possibility of such damages. Our total liability to you, in the aggregate, will not exceed the greater of (a) $100, or (b) the amount you paid CCF in the 12 months preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless CCF and its directors, officers, employees, volunteers, and contractors from any claim, demand, or expense (including reasonable attorneys' fees) arising from your misuse of the site or violation of these Terms.

10. Termination

We may suspend or terminate your access to the site or any feature at any time, with or without notice, if you violate these Terms or if we discontinue the feature. Sections 5, 7, 8, 9, and 12 survive termination.

11. Changes

We may update these Terms. The effective date at the top tracks the current version. Material changes will be announced via our newsletter and, where appropriate, by email. Continued use after the effective date constitutes acceptance.

12. Governing law and venue

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the site will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.
